Embezzlement is a form of securities fraud involving “ … illicit and unauthorized actions by brokers to steal directly from their clients. Such schemes may be facilitated by the forging of client documents, doctoring of account statements, unauthorized trading/funds transfer activities, or other conduct in breach of the broker’s fiduciary responsibilities to the victim client,” according to the FBI.

Class 2 felony: The embezzled property’s value is worth $25,000 or more.
- Punishable by up to 10 years in prison
- Up to 7 years of probation
Class 3 felony: The embezzled property’s value is worth between $4,000 and $25,000.
- Punishable by up to 7 years in prison
- Up to 5 years of probation
Class 4 felony: The embezzled property’s value is worth between $3,000 and $4,000, or the property was a vehicle engine or transmission (regardless of value).

Class 5 felony: The embezzled property’s value is worth between $2,000 and $3,000.
- Punishable by up to 2 years in prison
