What Is Homicide in AZ?

Homicide is when one human being causes the death of another. However, violent crimes like murder and manslaughter are forms of homicide that differ based on whether there was intent to commit the crime or not. Murder and manslaughter are types of homicide that carry severe penalties, so if you are convicted of these crimes, you may face the following charges and penalties:

Negligent homicide: A person commits negligent homicide if, with criminal negligence, the person causes the death of another person, including an unborn child (at any stage of development).

  • Class 4 felony punishable by 1 to 3.75 years in prison

Manslaughter: A person commits manslaughter if they recklessly cause the death of another person orcommitsecond-degree murder upon a sudden fight or heat of passion resulting from adequate provocation by the victim. Manslaughter involves second-degree murder resulting from threats or coercion using unlawful physical force. It also involves intentionally providing the physical means for a person to commit suicide, with the knowledge that the person intends to do so.

  • Class 2 felony punishable by 3 to 12.5 years in prison

First-degree murder: A person commits first-degree murder if they intend or know that their conduct will cause death and causes the death of another person, including an unborn child, with premeditation.

  • Class 1 felony punishable by death or life imprisonment

Second-degree murder: A person commits second-degree murder if, without premeditation, they intentionally kill another person, including an unborn child. Or, as a result of intentionally killing another person, they cause the death of an unborn child. It also involves recklessly engaging in conduct that creates a grave risk of death and thereby causes the death of another person, including an unborn child.

  • Class 1 felony punishable by death or life imprisonment
