What Arizona Law Requires the State to Prove

Two separate statutory provisions often appear on the same charging document. Understanding the difference between them shapes the entire defense.

ARS 28-1381(A)(3)
This subsection makes it unlawful to drive or be in actual physical control of a vehicle while any drug defined under ARS 13-3401, or its metabolite, is present in the body. Proof of actual impairment isn’t required. A positive blood result alone can support a conviction under this provision. Arizona law does provide a statutory defense under ARS 28-1381(D): if the drug was prescribed by a licensed medical practitioner authorized to prescribe it, that prescription is a defense to the (A)(3) charge. It doesn’t automatically defeat a separate impairment charge.

ARS 28-1381(A)(1)
This subsection prohibits driving while impaired to the slightest degree by any drug or substance. Here, the prosecution must prove actual impairment at the time of driving, not just drug possession. Charges under both subsections are frequently filed together.

One important development involves marijuana specifically. In 2014, the Arizona Supreme Court held in State ex rel. Montgomery v. Harris that the presence of only Carboxy THC, the non-impairing metabolite of marijuana, without evidence of actual impairment, supports dismissal of an (A)(3) charge. Marijuana metabolites can remain detectable in blood for weeks after last use, and that gap between detection and actual impairment is a meaningful defense issue in the right case. This ruling applies to that specific metabolite; the law regarding other metabolites remains unsettled.

Penalties a Drug DUI Conviction Carries

A first-offense DUID charged as a Class 1 misdemeanor carries up to six months in jail, fines up to $2,500 plus surcharges, and up to five years of probation. Mandatory minimums apply even on a first offense: mandatory jail time, a drug assessment and treatment requirement, community service, a victim impact panel, and traffic survival school. License suspension and SR-22 insurance requirements follow a conviction, and the court may order an ignition interlock device.

Certain circumstances elevate a Drug DUI to a felony Aggravated DUI: a prior DUI within 84 months, a suspended or revoked license at the time of the stop, or a passenger under 15 in the vehicle. Beyond the criminal sentence, a conviction creates a permanent record that can affect professional licenses and, for non-citizens, carries potential immigration consequences.
