Arizona First-Offense DUI Charges & Consequences

Arizona recognizes several DUI classifications based in part on blood alcohol concentration. A standard DUI generally involves a BAC of at least 0.08% but less than 0.15%. An extreme DUI generally begins at 0.15%, while a super extreme DUI generally begins at 0.20%.

These categories don’t cover every way the state may allege DUI, and the applicable classification depends on the charge and evidence. Having no prior DUI conviction doesn’t make the case minor or suggest lenient treatment.

Potential consequences may include:

  • Jail and financial penalties
  • Alcohol or drug screening
  • Traffic Survival School
  • License suspension or restricted driving privileges
  • Installation of an ignition interlock device
  • Proof of future financial responsibility

The Arizona Motor Vehicle Division Has a Separate Process

The driver’s license process is related to the criminal case, but it’s a distinct administrative matter. According to the Arizona Department of Transportation, a court conviction isn’t always required for the Arizona Motor Vehicle Division to impose an administrative license suspension.

Under Arizona implied consent law, drivers are deemed to have consented to qualifying alcohol or drug testing after a DUI arrest. Chemical-testing issues can trigger a suspension process, and the notice may provide only 30 days from its date to request a hearing. Because the notice controls, review it promptly rather than assuming the criminal court will address the license issue.

Requesting a hearing can preserve the opportunity to challenge the administrative action. It doesn’t resolve the criminal charge, and developments in one proceeding don’t necessarily determine the other.
